Registering a business
Registering a business name in the state or territory in which you operate your small
business is compulsory. New companies must register with the Australian Security
& Investments Commission (ASIC). This page will help you find out what you need
to know and where to go for company registration and business name registration.

The name you choose to trade under will identify your business from other
businesses in your state or territory.

Choosing a business name
Choosing the right name is very important to your business.
ASIC's Identical Names Check is a record of all company and business
names registered in Australia, as well as some association names. You
can search the Check, free of charge, to see if your proposed business
name already exists. You should also ensure that your proposed business
name does not infringe any trade mark by checking with IP Australia.

Register your business name
Business names are issued in the state or territory in which the business or trade is
carried out.

Business name registration
Businesses that are not companies (eg individuals/sole traders, trusts and
partnerships) are required to register their business name in the state and territory in
which they will operate. The exception to this is if they conduct their activity only
under the name of the person or persons involved (i.e. first name and surname, or
initials and surname). Go to your state or territory listed below for a link to the
appropriate agency.

Register your company
ASIC (Australian Securities and Investments Commission) is responsible for the
registration of companies.

Register a company
New companies must be registered with ASIC in order to be recognised as Australian
companies under the Corporations Law. The first step in is to ensure that the
proposed name is available for registration as a company. Search ASIC's Identical
Names Check to see if your proposed company name is identical to another name
already registered. To register, complete and lodge From 201 ?application for
registration as a company? together with the prescribed fee. You can lodge it in
person at any Asic service centre or by mail to: ASIC, PO Box 4000, Gippsland Mail
Centre, VIC 3841.

Check and change company details on line
New online service for checking and changing your company details. If you are a
current eRegisters user, you need to re-register for the new online service.

Register your domain name
Your domain name is your address on the internet and gives you an online identity or
brand. It is a valuable part of your business identity and an important marketing tool.

Registering a domain name
If you intend to trade online, registering your website address (domain name) should
be an early step in implementing your business plan. The Department of
Communication, Information Technology and the Arts' e-businessguide provides
information on getting a website name Visit the .au Domain Administration Ltd
website, www.auda.org.au, for links to registrars and resellers, to confirm current

fees and options.

Register for Taxation

If you're in business the Tax Office encourages you to register for an Australian
Business Number (ABN). You may also need to register for GST.

Apply for your ABN, GST, TFN
You can apply for your ABN and register for GST, TFN and PAYG through the
Business Entry Point's ABRpublic site. If all necessary information has been provided
in the application process, you will receive your ABN during the same internet
session at the end of the registration process. Written notification of the ABN and any
associated registration applications (eg GST) will also be mailed to you within 28
days of receipt by the ATO.

Register your trade mark
A registered trade mark gives you the exclusive legal right to use, license or sell it
within Australia for the goods and services for which it is registered.

Registering a business trademark
A trademark is a letter, word, phrase, sound, smell, colour, shape, logo, picture,
aspect of packaging, or any combination of these. It is used to distinguish your goods
and services from the goods and services of other traders. You can search IP
Australia?s online databases for similar trade marks, basic trade mark details and an
image of the trade mark if applicable.

State and Territory Governments
Registration of a business name is compulsory and must be completed before the
business starts trading. Where trading occurs in more than one state or territory, the
business name must be registered under the laws of each.

South Australia

Registering your business name
You can find information about registering your business name in South Australia at
the Office of Consumer and Business Affairs. An application form for registering a
new business name (and changing the particulars to an existing business name) can
be downloaded and lodged either by mail, fax or in person. A registration fee is
applicable. You will need to renew your business name every 3 years.
